We reserve the right to change the terms and conditions under which the website and the goods are provided. Any such change in terms and conditions will be effective to all new orders once included in the text of these terms and conditions and published on the website.

We try to make sure that all information on the website, including descriptions of our goods, and listed prices, are accurate and correct at all times. Please note: Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown and will not include any of the pictured accessories, unless stated in the specification of the goods. We have made every effort to display as accurately as possible the colours of our products that appear on this website. However, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the actual goods.

Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith. In the unlikely event that a mistake happens, we will try to resolve it as soon as reasonably possible, and if we reasonably think that such an error has affected your purchase of goods we will try to let you know. However, because we take these steps we will not be liable to you for any errors on the website.
Placing an order

You make an offer to purchase a product from us (your “Order”) by selecting the product and adding it to your shopping basket, completing your details including your address and making a payment.

 

Your Order only constitutes an offer to purchase goods from us, and does not form a binding contract until accepted by us. Where you order more than one product your Order contains a series of offers for each product individually.

On receipt of your Order, we will send you an email acknowledgement to the email address which you provide in the order process. This acknowledgement email will contain details of the goods ordered. Please note that this email is only to acknowledge that your Order has been received, and is not acceptance by us of any offers to purchase goods.

We must receive full payment both of the price of the goods and any delivery charges before we can accept any offers.  The postal charges will be shown when items have been added to your basket.  We use secure payment facilities for online purchases. You can pay for your order by Paypal (Visa, Mastercard, Maestro and American Express).
An offer made by you to purchase a product shall only be deemed to be accepted by us when we despatch that product to you and send you an order despatch email which includes details of the goods. Once your goods have been despatched, changes will not be possible.  We reserve the right to refuse any offers in an order prior to acceptance.

 

In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this by email and there will be no contract between us.
Promotions

We may from time to time offer promotional offers on purchase made through the website.

All offers and promotions are at Private Encounter’s discretion and are subject to variation or withdrawal without notice.

Offers or promotions cannot be applied to previously ordered items and the promotional prices only apply during the period stated.

All items are subject to availability at time of order.

Only one promotional code can be used per order. Any orders using more than one promotional code will be cancelled.

Voucher codes cannot be used in conjunction with any other offer.

 

Delivery

Goods will normally be dispatched within 3 working days and any estimated dispatch date is an estimate, which can change without notice.

Goods will normally be delivered within 1-3 working days of dispatch. Please be aware if Royal Mail or Parcelforce has Industrial Action there will be a backlog of post and delivery can take longer. Additionally for other reasons beyond our control, goods might not be delivered as planned. These might include things such as accidents, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. We cannot be held responsible where this causes a delay or failure in delivering your goods. Please therefore allow plenty of time for delivery.

Once an order has been dispatched it becomes the property and responsibility of either Royal Mail, Parcelforce or our couriers to be delivered not Private Encounter. All items purchased from the Private Encounter website are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you, the buyer, upon our delivery to Royal Mail, our couriers or Parcelforce.

Your order may arrive in more than one delivery.

Goods will be delivered to the premises you specify on your order. We will not accept responsibility for loss or damage if you instruct the delivery company to leave the goods unattended.

If goods are returned to us, for reasons such as uncollected from the Post Office or address unknown, we reserve the right to charge you an additional re-delivery charge.

If you change the delivery address once the goods have been dispatched to you, the responsibility is with you.

Returns and Faulty Goods

Please check the goods on delivery – any goods found to be missing or damaged should be notified to ourselves within 14 days.

Please note: Due to the nature of our business particular scrutiny will be used in connection with returning faulty, damaged or unwanted goods. If there is a discrepancy over the returned goods Private Encounter will contact you within 7 days of receipt to discuss this. If goods are faulty, damaged or unwanted and you fail to inform us of this within 14 days then Private Encounter shall consider the products being as described, of satisfactory quality and fit for their purposes and we may not accept any reject at a later date.

 Warranties and Liabilities

We warrant that we have the right to sell the Goods, but otherwise all other warranties, conditions or terms relating to fitness for purpose, quality or condition of the Goods, whether express or implied by statute or common law or otherwise, are excluded to the fullest extent permitted by law.

In no event shall we be liable to you, the buyer for any loss of business, loss of opportunity, loss of profits, depletion of goodwill and/or similar losses or for any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses whatsoever (howsoever caused) which arise out of or in connection with this contract.  Private Encounter will be not liable for any direct, indirect, punitive, incidental, special consequential damages, to property or person, whatsoever arising out of or connected with misuse of our products. Nothing in these terms shall exclude or limit the Seller’s liability for death or personal injury resulting from the Seller’s negligence or that of its employees.
